Professional Liability

Firm attorneys represent professionals including attorneys, accountants, physicians, architects and other professionals in the defense of malpractice, breach of fiduciary duty, fraud, and statutory causes of action. In addition, firm attorneys have represented claimants against various professionals in such professional liability actions.

Reprentative matters:

* Represented Attorney sued for malpractice by client who asserted that Attorney failed to plead appropriate defenses and respond to discovery which resulted in the trial court striking the clients defenses in the underlying matter. Attorney was fired in the underlying matter and underlying case proceeded to trial, where former client lost and had judgment entered against it for significant monies. Malpractice case went to trial and we were able to obtain a directed verdict on behalf of the defendant attorney based upon the fact that after the sanctions were entered in the underlying matter, and the defenses were stricken, the underlying Plaintiff amended its complaint, and as a matter of law, new counsel representing the former client had every right to re-plead all defenses and failed to do so. Thus, the trial court in the malpractice action ruled that as a matter of law the defendant attorney’s actions could not be the proximate cause of any damages.

* Represented Plaintiff/Counterdefendants in an action involving a business dissolution between family members, which also included professional malpractice claims against attorneys and accountants. Claims between family members sounded ini breach of contract, breach of fiduciary duty, and fraud. Claims against accountants and attorneys sounded in negligence, breach of fiduciary duty and fraud. Claims brought on behalf of client against family members were settled pre-trial involving transfer of valuable real estate to client. Claim against accountant was settled for payment of significant monies to clients. Claims against attorneys went to trial and the jury awarded damages to client which was settled during pendency of appeal.
